Terms of Use — MCS Driver App

These terms cover the MCS Driver App only. The Alienegg Mobile Terms of Service govern the Alienegg Mobile games and do not apply to this app. This app is a business tool, not a consumer game.

These Terms of Use govern your use of the MCS Driver App (the "App"), provided by Motor Carrier Solutions ("MCS," "we," "us," or "our") and published on app stores by Alienegg Mobile LLC. By installing or using the App, you agree to these Terms.

1. Who may use the App

The App is provided for prospective and current drivers of Motor Carrier Solutions for the purpose of completing and submitting a driver employment application. It is not offered for general public use. You must be at least 18 years old to use it.

2. Accuracy of what you submit

A driver employment application is a regulated document. You agree that the information you enter is true, complete, and your own, and that the signature you provide is yours. Federal regulation requires that you certify your application; knowingly providing false information may disqualify you from employment, may be grounds for termination if discovered later, and may carry consequences under law.

3. Your information

How your information is collected, used, retained, and shared is described in the MCS Driver App Privacy Policy, which forms part of these Terms. Submitting an application is not an offer or guarantee of employment.

4. Acceptable use

Do not submit an application on behalf of another person, or use another person's identity, license, or signature;
Do not attempt to reverse engineer, decompile, or extract the source code of the App, except where the law permits it;
Do not attempt to disrupt, overload, or gain unauthorized access to the App or the systems it connects to;
Do not use the App to break any law or to infringe anyone's rights.

5. Device and connectivity

The App can be used without a network connection and transmits your application when a connection is available. You are responsible for your own device and data charges. Keep your device secured: until an application is transmitted, it is held in encrypted form on your device, and anyone with access to an unlocked device may be able to view what you have entered.

6. Availability and changes

We may update, suspend, or discontinue the App or any part of it, and may revise these Terms. When we revise them we will update the "Last updated" date above. Continued use after a change takes effect means you accept the revised Terms.

7. Ownership

The App, including its code, design, and content, is owned by its respective owners and protected by intellectual property law. Nothing in these Terms transfers ownership to you. Your application data remains subject to the Privacy Policy.

8. No warranty

The App is provided "as is" and "as available," without warranties of any kind, express or implied. We do not warrant that it will be uninterrupted or error-free. If the App fails to transmit an application, contact us using the address below so that your application can be completed by another means.

9. Limitation of liability

To the fullest extent permitted by law, Motor Carrier Solutions and Alienegg Mobile LLC will not be liable for indirect, incidental, special, consequential, or punitive damages arising out of your use of the App. Nothing in these Terms limits any right you have that cannot be limited by law, including rights you may have as an applicant or employee.

10. App store terms

Where the App is obtained through an app store or an enterprise distribution program, that provider's terms also apply to your use.

11. Governing law

These Terms are governed by the laws of the Commonwealth of Kentucky, USA, without regard to its conflict-of-law rules.
